EU DIGITAL SINGLE MARKET

Over the summer we have finalized our positions on the Commission's proposals on whistleblowing and on platforms to business.

ONLINE DISINFORMATION

On 24 August Platforms, advertisers and ad network companies presented a proposal for a Code of Practice to tackle disinformation. The Sounding Board, i.e. representatives of the media, civil society, fact-checkers and individual academics adopted its opinion on the draft Code on September 3.
The self-regulatory Code will only commit platforms, advertisers and ad companies, and they will decide which of the Sounding Board's comments to take on board. Final adoption of the Code and the official opinion of the Sounding Board is scheduled for 20 September.
So far, from a broadcasters' point of view the draft Code does not meet expectations. The EBU is considering its next steps, along with other members of the Sounding Board.

LEGAL CASE NOTE: GERMAN CONSTITUTIONAL COURT RULING ON FUNDING

In its judgment of 18 July 2018, the German Federal Constitutional Court has upheld the PSM funding model of a "broadcasting contribution" (Rundfunkbeitrag) and in doing so has highlighted the key role played by PSM in today's digital media landscape.

LEGAL CASE NOTE: EUROPEAN COURT RULING ON USE OF PERSONAL DATA

In a judgment of 5 June 2018, the Court of Justice of the European Union has ruled that Administrators of Facebook Fan Pages are jointly responsible, alongside Facebook, as data controllers for the processing of personal data of their Fan Page visitors.

EBU SURVEY ON AUDIENCE OMBUDSMEN

We have recently conducted a survey to find out what formalized mechanisms EBU Members have in place to process complaints and suggestions and to respond and take action as the case may be.

17 Members provided us with information on their organization, the summary of replies to the Survey on Audience Ombudsman can be found here.

Members who have not yet replied are welcome to contact Ausra Semeniene to provide information on their organization.

NEW EU-FUNDED PROJECT

The EBU Brussels office has won an EC tender aimed at raising awareness on migrants' contribution to EU societies. The project, called "New Neighbours", will be implemented in collaboration with several civil society and community media organizations and will have as its main objective to mobilize media and civil society actors to foster greater intercultural understanding between migrants and host communities in Europe.

The EBU Intercultural and Diversity Group will coordinate the production of documentaries while the Brussels office will manage the whole project. The project is expected to start by the end of the year, for more information, please contact Christel Goossens
